Eligible OperationsThis program is intended for firms engaged in the installation/construction, service, maintenance and repair of swimming pools and spas. Not available in AK, AZ, CA, CO, HI, IL, LA, NV, NM, OR, TX and WA. Sixty-five (65%) or more of the payroll or sales must be derived from the following operations, either singly or in combination with each other:
Builders or installers of swimming pools, spas and hot tubs, including pool plasterers. Service, maintenance and repair work (i.e., cleaning, painting, resurfacing, winterizing, etc.) done exclusively for the swimming pool, spa and hot tub industry. Retailers selling above ground pools, spas, hot tubs and other equipment, supplies and accessories. Includes seasonal items such as holiday decorations, billiards, and fireplace accessories, etc. 100% retail operations are not eligible.Wholesalers of goods manufactured by others for the swimming pool, spa and hot tub industry. 100% wholesale/distribution operations are not eligible.Ineligible OperationsInstallation or construction of indoor residential spas or swimming pools. 100% pool & spa chemical wholesale/distribution. These chemicals may include chlorinating agents, algaecides, chlorine stabilizers, pH adjusters, alkalinity adjusters, cleaning agents, water clarifiers and spa chemicals.Pool & spa chemical repackaging, formulation, mixing, blending or dilution. Building, installation or maintenance of industrial and chemical sedimentation ponds or sewer/waste water collection ponds. Elevated swimming pool installation in upper floors or rooftops of existing or newly constructed buildings. Distributors importing foreign products. Hourly rental services of spas, sun tanning booths, hot tubs, etc. on or off premises. Professional, public, semipublic or private pool management services (i.e., lifeguard, etc.). Sales of recreational vehicles (i.e., golf carts, snowmobiles, mopeds, motor cycles). Manufacturers of pool or spa components, products or supplies.Specialized CoveragesGeneral Liability
Broadened Property Damage “Pop-Up” Coverage - Swimming PoolsU: Otherwise known as "Pool Pop-Up" coverage, this endorsement is designed to cover property damage to swimming pools that are either "your work" or are sold by the insured when these swimming pools are damaged by "pop-up" which is the elevation of a swimming pool due to a high water table. General Liability Extension Endorsement: This endorsement to the general liability policy offers numerous enhancements normally needed by contractors. These include but are not limited to: excess and “d.i.c.” coverage for non-residential wrap-ups, automatic additional insured status for state or political subdivisions (permits, contractual liability), aggregate limits per project, newly formed or acquired organizations, expanded bodily injury and much more. Limited Pollution Coverage - Worksite: Provides coverage for third party bodily injury and property damage (including clean up costs) which directly results from a covered pollution incident. Limits are available up to $1,000,000/2,000,000. Defense costs are covered in addition to the policy limits. Limited Pollution Liability Coverage: Provides coverage for third party damages caused by a release of pollutants either from premises owned, rented to, or occupied by the risk (subject to the release beginning and ending within 72 hours and originating above ground) or at sites where the risk is performing operations (no time limit applies). Separate limits up to the policy limits of the CGL are available. Defense expense is covered as a supplementary payment. Preventative remedial expense coverage is provided. We will reimburse the insured up to $25,000 per year, to clean-up pollutants on the insured’s premises from a covered pollution incident, before BI or PD occurs.
